Terms of Service for Ted (Track Every Day)

1. Acceptance of Terms

By accessing or using the Ted (Track Every Day) mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Ted is a project management and financial tracking application designed for homeowners, builders, and beneficiaries to:

• Track renovation and construction project expenses
• Manage project documentation and receipts
• Collaborate with multiple stakeholders
• Share payment information with authorized beneficiaries
• Maintain project journals and records

3. User Accounts

3.1 Account Creation

• You must provide a valid phone number to create an account
• You must be at least 13 years old to use the App
• You are responsible for maintaining the confidentiality of your account
• You agree to provide accurate, current, and complete information

3.2 Account Security

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized use
• We are not liable for any loss resulting from unauthorized account access

3.3 User Types

The App supports three user types:

• Homeowner: Full project ownership and management rights
• Builder/Collaborator: Can add payments and documentation to projects they're invited to
• Beneficiary: View-only access to payments for projects they're authorized to view

4. User Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Upload false, inaccurate, or misleading information
• Impersonate any person or entity
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to any part of the App
• Use automated systems to access the App without permission
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices

5. Content and Data

5.1 Your Content

• You retain ownership of all content you upload (photos, documents, notes, payment records)
• You grant us a license to use, store, and display your content to provide the Service
• You are responsible for the accuracy of your data
• You must have the right to upload any content you share

5.2 Data Sharing

• When you invite collaborators or beneficiaries, they gain access to specified project data
• You are responsible for managing who has access to your projects
• We are not responsible for how collaborators use shared data

5.3 Prohibited Content

You may not upload content that is:

• Illegal, harmful, or violates any laws
• Infringes on intellectual property rights
• Contains malware or viruses
• Harassing, abusive, or threatening

6. Financial Information

You are solely responsible for the accuracy of financial records and for complying with tax and accounting requirements.

7. Intellectual Property

• The App and its original content, features, and functionality are owned by Ted and protected by copyright and trademark laws
• Our trademarks and trade dress may not be used without written permission
• You may not copy, modify, distribute, or create derivative works of the App

8. Third-Party Services

The App may integrate with third-party services (AWS, Expo, etc.). We are not responsible for:

• The availability or functionality of third-party services
• Third-party privacy practices or terms
• Content or services provided by third parties

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Data will be accurate or backed up without loss
• Defects will be corrected
• The App is free of viruses or harmful components

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from unauthorized access to your account
• Disputes between users

OUR TOTAL LIABILITY SHALL NOT EXCEED £100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify and hold harmless Ted and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or share

12.1 By You

You may terminate your account at any time by contacting us. Upon termination, your right to use the App ceases immediately.

12.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• We are required by law
• Your account has been inactive for an extended period
• We discontinue the App

12.3 Effect of Termination

• You lose access to your account and data
• We may delete your data after termination
• Provisions regarding liability, indemnification, and disputes survive termination

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting a notice in the App
• Updating the "Last Updated" date
• Sending a notification (if applicable)

Continued use of the App after changes constitutes acceptance of the new Terms.

14. Modifications to Service

We reserve the right to:

• Modify or discontinue features of the App
• Change pricing (with notice)
• Limit storage or usage

We are not liable for any modification, suspension, or discontinuance of the App.

15. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved in the courts of England and Wales.

16. Dispute Resolution

In the event of a dispute:

• Contact us first to seek informal resolution
• If unresolved, disputes may be submitted to mediation
• Legal action must be brought within one year of the claim arising

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Ted regarding the App.

19. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

By using Ted, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
